Welcome to Your American Flag Store. All products sold through this website are handcrafted, made-to-order products created with pride in the United States.

By purchasing, receiving, unpacking, transporting, installing, displaying, or otherwise using any product purchased from Your American Flag Store, you acknowledge and agree to the terms, conditions, warnings, and limitations contained in this Legal Notice.

1. HANDCRAFTED PRODUCTS

Our American Flags are individually handcrafted from solid wood. Because each flag is handmade, variations in wood grain, color, texture, knots, character, finish, distressing, paint application, dimensions, and other natural characteristics may occur.

These variations are not considered defects and are part of the unique character of a handcrafted wood product.

Our products are made to order, and each flag may require different amounts of time to manufacture depending on its size, design, customization, finish, and complexity.

2. PRODUCT INSPECTION

Customers are responsible for carefully inspecting their product immediately upon delivery and before unpacking, transporting, handling, installing, mounting, or displaying it.

Because our products are made from solid wood and may contain natural wood characteristics, customers should exercise appropriate care when handling them.

If a product appears damaged upon arrival, customers should photograph the packaging and product and contact us promptly before attempting to repair, alter, install, or use the product.

3. HANDLING AND UNPACKING

Solid wood products can be heavy and may contain sharp corners, edges, hardware, fasteners, or other components that can cause injury if improperly handled.

Wood products may also contain natural wood fibers or splinters.

Customers should use reasonable care when unpacking, carrying, transporting, installing, or displaying their flag.

Your American Flag Store is not responsible for injuries, property damage, or other losses resulting from improper handling, unpacking, transportation, installation, mounting, or use of our products.

Customers should use appropriate protective equipment and assistance when necessary, particularly when handling larger or heavier flags.

4. INSTALLATION AND MOUNTING

Customers are solely responsible for determining the appropriate method of mounting and securing their flag based upon the wall, surface, structure, location, weight of the product, mounting hardware, and environmental conditions.

Any mounting hardware, hanging system, screws, anchors, hooks, brackets, or other installation components supplied with or recommended for a product must be used appropriately and in accordance with their intended purpose.

Your American Flag Store does not guarantee that any particular wall, surface, mounting method, hardware, anchor, hook, bracket, or installation system will safely support a particular product.

The customer is responsible for determining whether the selected mounting method is appropriate for the intended installation location.

Professional installation is recommended when appropriate.

5. ASSUMPTION OF RISK

By purchasing and using our products, you acknowledge that handling, transporting, mounting, installing, and displaying handcrafted solid wood products involves certain inherent risks.

These risks may include, but are not limited to:

  • Dropping the flag or product on yourself or another person;

  • Foot, hand, or other bodily injury caused by dropping or mishandling the product;

  • Cuts, scratches, or splinters resulting from handling or unpacking the product;

  • Injury resulting from sharp corners, edges, hardware, or wood components;

  • Damage to walls, ceilings, furniture, floors, vehicles, or other property;

  • The flag or mounting hardware becoming detached from a wall or other surface;

  • Damage resulting from improper installation or mounting;

  • Damage resulting from inadequate or inappropriate mounting hardware;

  • Damage caused by transporting or moving the product;

  • Damage resulting from improper use, modification, alteration, repair, or maintenance;

  • Damage resulting from environmental conditions, including wind, moisture, heat, cold, sunlight, or other conditions where applicable.

You voluntarily assume responsibility for these risks and agree to exercise reasonable care when handling, installing, transporting, and displaying your product.

6. FALLING OR DETACHED PRODUCTS

Your American Flag Store is not responsible for damage or injury resulting from a flag, mounting hardware, or other product becoming detached from a wall, ceiling, structure, vehicle, or other mounting surface when such detachment results from improper installation, inadequate mounting hardware, unsuitable mounting surfaces, failure to properly secure the product, modification of the product or mounting system, or other circumstances outside our control.

Customers are responsible for periodically inspecting their flag and mounting hardware and taking appropriate action if anything appears loose, damaged, unstable, or unsafe.

7. PRODUCT MODIFICATION

Altering, modifying, drilling, cutting, sanding, refinishing, painting, repairing, adding hardware to, or otherwise changing a product after purchase may affect its structural integrity and safety.

Your American Flag Store is not responsible for damage or injury resulting from unauthorized modifications or alterations to our products.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Your American Flag Store, its owners, employees, contractors, affiliates, suppliers, and representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, or other damages arising from or related to the purchase, possession, handling, transportation, installation, mounting, display, modification, or use of our products.

This includes, without limitation, personal injury, property damage, damage to walls or other structures, damage caused by a falling or detached product, or injury resulting from dropping, unpacking, transporting, mounting, or handling a product.

Nothing in this Legal Notice is intended to exclude or limit liability to the extent that such liability cannot legally be excluded or limited under applicable law.

9. NO GUARANTEE OF PARTICULAR INSTALLATION

Because every installation environment is different, Your American Flag Store cannot guarantee that a particular flag will remain securely mounted in every location or under every set of circumstances.

Wall construction, studs, drywall, brick, concrete, wood, siding, mounting surfaces, environmental conditions, hardware, installation technique, and other factors can affect the security of a mounted product.

The customer is responsible for selecting an appropriate installation method and ensuring that the product is securely mounted.

10. RETURNS, CANCELLATIONS AND REFUNDS

All purchases are subject to our Return Policy, which is incorporated into these Terms by reference.

Because our products are handcrafted and made to order, customers should carefully review their order before submitting it.

Our current Return Policy provides for returns within three (3) days after purchase, subject to the conditions stated in the Return Policy.

Orders cancelled after the applicable cancellation period may be subject to a 10% restocking fee, reflecting the made-to-order nature of our products and materials and labor committed to producing the order.

11. FULFILLMENT TIMES

Because our products are individually handcrafted and made to order, fulfillment times may vary.

Our typical fulfillment time is approximately 3–8 weeks, depending upon the size, design, customization, finish, and complexity of the flag ordered.

Fulfillment times are estimates and are not guaranteed delivery dates.

12. CUSTOMER RESPONSIBILITY

By purchasing a product from Your American Flag Store, the customer acknowledges responsibility for:

  1. Carefully unpacking the product;

  2. Inspecting the product before use;

  3. Using reasonable care when handling the product;

  4. Selecting appropriate mounting hardware;

  5. Determining whether the installation surface is suitable;

  6. Properly securing the product;

  7. Periodically inspecting the product and mounting hardware;

  8. Following applicable manufacturer or hardware instructions;

  9. Keeping children and pets away from installation activities and unsecured products; and

  10. Discontinuing use if the product or mounting system appears damaged, loose, unstable, or unsafe.

13. SEVERABILITY

If any provision of this Legal Notice is determined to be invalid, unlawful, or unenforceable under applicable law, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. GOVERNING LAW

This Legal Notice and any dispute arising from the purchase or use of our products shall be governed by the applicable laws of the State of Tennessee, without regard to conflict-of-law principles, except to the extent that applicable law requires otherwise.

15. CHANGES TO THIS NOTICE

Your American Flag Store reserves the right to modify or update this Legal Notice from time to time. Any updated version will be posted on this website with the applicable effective date.

Your continued use of our website or purchase of products following the posting of changes constitutes acceptance of the updated Legal Notice to the extent permitted by applicable law.
